Potential Impact Of Invalidating The Affordable Care Act On The Individual Market

Oliver Wyman prepared this report for the Blue Cross and Blue Shield Association (“BCBSA”) in support of its amicus curiae brief in Texas v. United States (the “Litigation”).

Our report contains an Executive Summary, an Analysis using our Healthcare Reform Micro-Simulation Model (HRMM) to illustrate the real-world impact of several possible outcomes of the Litigation on the individual market for health insurance, and an Appendix describing our methods.

In short, we find that the individual health insurance market would function better if the Affordable Care Act’s (the “ACA”) individual mandate to purchase insurance is enforced through an individual mandate payment, as it was before reforms enacted in 2017. Even without such a payment, however, an individual market that operates pursuant to the ACA’s other key provisions will provide affordable health insurance to millions more enrollees than a market without these provisions.
